Leitner Varughese PLLC secures $900,000.00 Judgment against Home Care Agency on behalf of a 93-year-

The trial attorneys at Leitner Varughese PLLC recently secured a $900,000.00 judgment against a home care agency in the Supreme Court of Bronx County on behalf of a 93-year-old victim of alleged negligence. It was argued that the home care agency deprived our client of her right to receive adequate and appropriate medical care and deviated from accepted medical standards, causing the victim to suffer pain, suffering, and further deconditioning resulting in unnecessary hospitalizations, loss of function, and a loss of quality of life.

It was alleged that the defendant home care agency violated numerous requirements, and failed to exercise reasonable and necessary care, by failing to properly assess our client's risk of falling, and failing to institute appropriate interventions and reasonable prevention measures so as to lessen her risk of falling, which increased her risk of harm and caused her injuries. By failing to provide proper care, the home care agency allowed our client to fall and sustain a cervical spine fracture at C4, cervical spine fracture at C5 extending into lamina, spinal ligamentous injury and tearing, and a displaced nasal bone fracture, directly resulting in pain, suffering, hospitalizations, inpatient rehabilitation services, deconditioning, loss of function, and a loss of quality of life.

The home care agency's records indicated that our client was “High Risk” for falling, and consequently required “constant observation”, close supervision, and safety precautions. The instructions were to provide assistance with all activities of daily living, including to assist her with toileting, transferring, walking and safety supervision. It was alleged that the defendant home care agency failed to provide constant observation, close supervision, and safety precautions to Leitner Varughese's client, as was required by her Plan of Care, and the agency's orders and directives.
