Two Leitner Varughese Warywoda victories featured in the Top 100 Settlements in New York



New York personal injury and wrongful death law firm Leitner Varughese Warywoda PLLC is honored to report that two of the firm's victories were selected today to the Top 100 Settlements in New York list for 2019 just published by TopVerdict.com.

The first case recognized by Top 100 Settlements involved a 96-year-old resident of a Kings County (Brooklyn), New York nursing home who sustained a fall resulting in a fracture of her hip. It was alleged that the nursing home failed to implement interventions customarily utilized in nursing facilities to lower risk of falls and injury, that the nursing home's failure to implement safety precautions contributed to our deceased client's injuries, and that the nursing home failed to timely and appropriately assess and treat the injuries sustained.

The second case honored by Top 100 Settlements involved allegations that a Suffolk County, New York nursing home failed to prevent our elderly client from sustaining painful Stage IV decubitus ulcers ("bed sores"), specifically by failing to assist our client in turning in bed to prevent prolonged pressure on body areas susceptible to skin breakdown, failing to properly toilet our client, and failing to provide proper pressure-reliving devices such as an alternating air mattress.

The two chosen recoveries involved cases brought pursuant to New York Public Health Law § 2801-d, which provides a private statutory cause of action for residents of nursing homes injured as a result of the nursing home’s deprivation of certain “resident’s rights.”
