Leitner Varughese supports proposed New York State laws to protect nursing home residents and improv


There are a number of proposed laws, or bills, being introduced in the New York State Senate aimed at increasing nursing home care and standards for elderly New Yorkers.

The initial law would amplify the New York State Department of Health's ability to oversee, govern and enforce regulations on nursing homes. It would require the appointment of Independent Quality Monitors to be placed on substandard nursing homes and would allow the Department of Health to enter and become involved in dangerous nursing home facilities.

The next law would allow the Department of Health to perform their inspections at unpredictable dates and times. As of now, the DOH is confined to scheduled inspection times, and advance notice to nursing homes, which often allows nursing homes to clean, prepare, and "beef up" staffing levels of nurses and aides, in order to comply with federal and state regulations. The law would allows the DOH to perform inspections at times when nursing homes typically have skeleton crews of staff, including nights, weekends and holidays.

The final proposed law would prevent nursing home owners who have pending violations against them from buying other nursing homes. The proposed bill would create a two-year probationary period for nursing home owners between the time they comply and fix violations and the time they can buy yet another nursing home facility.
