The featured results include:

$900,000.00 - Home health care negligence – Failure of home care aide to prevent fall 93-year-old high risk patient – Cervical fractures – Displaced nasal fractures – Patient unable to undergo surgery because of age and health issues (Bronx County, NY)

This case involved a 93-year-old patient had a 24-hour per day home health aide. The defendant homecare agency’s records indicated that our client was “High Risk” for falling, and consequently required “constant observation”, close supervision, and safety precautions. The instructions were to provide assistance with all activities of daily living, including to assist her with toileting, transferring, walking and safety supervision

The plaintiff maintained that irrespective of these instructions, the aide negligently failed to set up the bed alarm before retiring for the night in another room. The plaintiff fell as she was walking to the bathroom in the middle of the night.

The plaintiff suffered a fracture at C4, and C5 which extended into the lamina, a cervical spinal ligamentous injury and tearing, and a displaced nasal bone fracture. The plaintiff could not undergo otherwise indicated surgery because of co-morbid conditions and required two months in a rehabilitation facility. The plaintiff contended that the pain, loss of function and reduced quality of life is very substantial. The court awarded $900,000.00.

$275,000.00 - Nursing home negligence – Failure to prevent decubitus ulcer in nursing home resident – Stage IV pressure sore – Death from unrelated causes less than two months later. (Suffolk County, NY)

This case involved a nursing home resident who was admitted for depression, bipolar disorder, a schizophrenic disorder, and aphasia in which it was alleged that the staff at the defendant nursing home violated the decedent’s rights as a nursing home resident.

The plaintiff maintained that the defendant failed to provide protection against adverse effects of pressure, friction and shearing; failed to assess the plaintiff’s decedent as high risk for skin breakdown based on his medical condition on admission; failed to provide wound care treatment as ordered by the physician and failed to properly provide appropriate pressure-relieving interventions to lessen the risk of pressure-related injuries.

The plaintiff contended that as a result, the plaintiff’s decedent developed a stage IV pressure ulcer to the sacrum requiring extensive treatment. He died less than two months later from unrelated causes. The defendant nursing home contended that it exercised all care reasonably necessary to prevent the skin breakdown.The case settled prior to the disclosure of experts for $275,000.00.
