It was alleged that despite our client's history of falling, the nursing home failed to implement interventions routinely utilized in nursing facilities to lower risk of falls and injury, and that defendant’s failure to institute individualized safety modifications substantially contributed to our deceased client's injuries. The case settled prior to trial for $325,000.00.
The second case listed in the Top 100 Settlements involved allegations of nursing home and hospital negligence, occurring at defendants’ respective facilities, which resulted in our 89-year-old deceased client sustaining extensive Stage IV decubitus ulcers ("bed sores"). The case settled prior to trial for $300,000.00.
Both cases were brought pursuant to New York Public Health Law § 2801-d, which provides a private statutory cause of action for residents of nursing homes injured as a result of the nursing home’s deprivation of certain “resident’s rights.”
